An action at law was brought by Jack Young and Entertainment Guild, Inc., against Fontainebleau Hotel Corporation on an entertainment contract. Plaintiffs alleged performance and sought as damages the return of a deposit and their unpaid share of the profits. Defendant answered with a general denial. Plaintiffs filed a motion for a partial summary judgment. Their proofs in support of the motion showed plaintiffs were entitled under the contract to recover a balance of $5,000 of an original $10,000 deposit and $8,799.23 of the profits or a total of $13,799.23 without dispute, and that there was a dispute as to some additional profits which required construction of the contract.
